1.3 By accessing or using the Website you agree to be bound to these Terms from the date on which you first access the Website. Please read these Terms carefully before you start using the Website. If you don't accept them, you should not use the Website. You will be bound by any such modifications or revisions from the time that they are made. 6.1 While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a retailer changes their prices we reserve the right to change the prices of goods and services on the Website without notice. All prices are stated are in New Zealand dollars unless referred to otherwise.

Gift Cards
9.1 Gift Cards may be issued, used and accepted, by Silverdale Mall including, where available, at Silverdale Mall and/or through the Website. The Gift Card remains the property of Silverdale Mall. It cannot be copied or reproduced in any circumstances. Gift Cards are not legal tender, account cards, credit or debit cards. However, they are to be treated as cash. Keep in a safe place as lost or stolen cards will not be replaced.
9.2 All Gift Cards are exclusive to Silverdale Mall and may be used in store at any participating retailers (‘Participating Retailers’) for their goods and services. Silverdale Mall will provide a list of Participating Retailers following your request. Gift Cards cannot be used for purchasing products online.
9.3 If Gift Cards are available, these may be loaded with any amount between $10.00 and $1,000.00. Each card can only be loaded at the time of purchase. Additional credit cannot be added to the Gift Card and you cannot consolidate multiple cards. Balances cannot be refunded, redeemed for cash nor will change be given. Gift Cards will expire as stipulated on the physical gift card, and all remaining unused balance will be forfeited.
9.4 Gift Cards are deemed void and not redeemable if they are defaced, altered or tampered with in any way and will not be replaced or reissued. Participating Retailers reserve the right not to accept payment or part payment of any item, where they reasonably suspect the Gift Card may have been stolen or obtained in any other illegal way.
9.5 Silverdale Mall is not liable for the availability, quality or fitness for purpose of any goods or services purchased with the Gift Card. Any disputes over goods or services purchased using a Gift Card must be resolved directly with the Participating Retailer from where they were purchased. Any disputes or errors in a transaction involving your Gift Card must be addressed to the Participating Retailer where the error was made to rectify the error. Reimbursed funds from returned goods cannot be returned to your Gift Card.
9.6 To the maximum extent permitted by law:
9.6.1 Silverdale Mall will not be liable to you for any costs, expenses, losses and damages you suffer whether direct, that may arise in connection with any goods or services purchased by the redemption of your Gift Card;
9.6.2 Silverdale Mall will not be liable to you for any indirect, special or consequential loss or damage arising under or in connection with these Terms; and
9.6.3 In the event Silverdale Mall is liable to you in relation to a Gift Card, this liability will not exceed the amount loaded onto that a Gift Card at the time of purchase.
9.7 Silverdale Mall may cancel any Gift Card, or the Gift Card programme, for any reason, at any time and without notice. Should this occur, a refund or replacement with an alternative Gift Card will be issued with the existing balance to the holder on presentation of their existing Gift Card.
Intellectual Property
10.1 Silverdale Mall either owns or otherwise has the right to use all copyright and other intellectual property rights in this Website and reserves all rights, save as provided in this disclaimer, and all such rights are reserved. You may electronically reproduce and store the contents of this Website solely for the purposes of viewing this Website, or saving Website content, for your own personal use.
10.2 Unless we have given our written consent, in relation to this Website you must not:
10.2.1 display or distribute the content of any of its pages in public or where the content is accessible to the public, including any reproduction in any form on the Internet;
10.2.2 assert any ownership or rights;
10.2.3 generate any profit from it or exploit it in any way; or
10.2.4 use, modify, alter, adapt, duplicate or amend it in any way whether directly or indirectly.
Restrictions
11.1 You are expressly and emphatically restricted from all of the following:
11.1.1 transferring or copying any Website material or publishing any Website material in any media;
11.1.2 selling, sublicensing and/or otherwise commercialising any Website materials;

Indemnity
12.1 You agree to indemnify and hold harmless Silverdale Mall to the fullest extent permissible by law from and against any and all losses, liabilities, claims, demands, damages, proceedings and expenses whatsoever (including legal or other costs associated with the enforcement or realisation of this indemnity), as suffered or incurred by the Silverdale Mall arising directly or indirectly out of any breach of or non-fulfilment of any of the obligations or undertakings under these Terms or arising out of or in any way related to your use of the Website.
Assignment
13.1 In the event of a change in ownership or management of Silverdale Mall, or of all or a portion of our Website, you acknowledge your personal information may be transferred to the new owner or management company, without requiring your further consent..
Compliance with Laws
14.1 You agree to comply with all applicable laws, statutes and regulations relevant in any way to your use of this Website or the material or functionality of this Website..
Invalidity
15.1 If any part of these Terms is unenforceable (including any provision excluding or limiting our liability) the enforceability of the remainder of these Terms will not be affected.
Governing Law
16.1 The use of the Website and these Terms shall be governed by and construed in accordance with the laws of New Zealand, and the courts of New Zealand shall have jurisdiction with respect to any legal action, suit or proceeding or any other matter arising out of or in connection with this Website.
